In compliance with the Personal Data Protection regulations and in accordance with the Regulation (UE) 2016/679 of the European Parliament and of the Council of 27 of April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”) and with the Organic Law 3/2018 of 5 December on the protection of personal data and the guarantee of digital rights (“LOPDGDD”), below Brill International, S.L.  (hereinafter, “Brill” or “We”) provides information on the processing of personal data of users of our platform web (hereinafter “Platform”).

2.    When Do We Collect Your Personal Data?

The Brill Platform is an informational website that collects personal data at the following times:

·         Through various forms: Our Platform has a contact form available so that you can reach out to us to request information about our services or make inquiries. When completing this form, we ask you to identify yourself and provide your contact information. Additionally, we have a registration form for you to sign up as a user. Finally, we also have a product purchase form.

3.    For what purposes and on what legal basis do we process your personal data?

If you registered as a user of our Platform, Brill will process your personal data for the following purposes and legal basis:

·         Provide and manage our services in accordance with the terms and conditions [RCD1] of the Platform; including but not limited to: the creation, configuration and management of your user account and profile on our Platform, and if necessary, blocking it and/or proceeding to its cancellation or cancellation; contact you for matters related to our Platform, and assist, manage and address any requests, comments and/or queries you make to us. 

Legal basis: By processing personal data for these purposes, the processing is carried out on the basis of the performance of a contract to which you are a party by registering on our Platform and accepting the terms and conditions [RCD2] of the Platform (Article 6.1.b) of the GDPR), and on the basis of your consent by submitting your request, comment and/or application to us, or deciding to share content on the Platform (Article 6.1.a) of the GDPR). 

·         During the use of the Platform, you can purchase or buy products. The data provided at the time of purchase or purchase of such products will be processed only to manage the conclusion of the contract as indicated in the terms and conditions [RCD3] of the Platform.

Legal basis: By processing personal data for this purpose, the processing is carried out on the basis of the performance of a contract to which you are a party by purchasing or buying products and/or services through our Platform and accepting the Platform's terms and conditions [RCD4]  (Article 6.1.b) of the GDPR). 

·         To comply with our legal obligations, possible judicial resolutions and other decisions determined by the authorities. Including the communication of personal data to law enforcement authorities, whenever we have suspicions or indications of an action that may constitute a criminal offense.

Legal basis: The processing of personal data for these purposes is carried out on the basis of compliance with the legal obligations of Brill (article 6.1.f) of the GDPR).

·         If you have not registered as a user on our Platform, but you contact us through the form provided to contact us and request information about our services or make inquiries, your personal information will be processed in order to assist, manage and respond to any requests, comments and/or inquiries you make.

 

Legal basis: The processing is done based on your consent when you contact us through the provided form or another enabled contact channel (Article 6.1.a) of the GDPR).

 

4.    How long will we keep personal data?

We will process your personal data as long as you keep your user active and once you unsubscribe the data will be stored for the time it is required for the exercise or defence against possible claims and to comply with legal obligations that may have arisen.

Personal data processed on the basis of the consent given will be kept until the withdrawal of the same, and once withdrawn, in some cases, we may keep them for the period necessary for the formulation, exercise or defence of claims, requirements, liabilities and legal and/or contractual obligations, always being duly blocked

 

5.    To which recipients may your data be disclosed?

Depending on the purposes for which personal information is collected, the following third parties may have access to personal data:

·         Public Administrations, Agencies and/or Competent Authorities and, the corresponding law enforcement authorities, in cases where there is a requirement, a legal obligation or we consider that there are sufficient indications and/or suspicions to be facing an illicit or criminal offense;

·         Partners and third-parties service providers who process information as data processors. All our suppliers have signed the corresponding data processing agreement in accordance with the personal data protection regulations;

·         When the user purchases products through the Platform, the payment data will be accessible to payment gateways. For more information on how your personal data is processed by these payment gateways, please read their privacy policies.

·         Employees and/or collaborators authorised by Brill, always subject to applicable data protection regulations;

 

Brill does not transfer personal data to countries outside the European Economic Area.  However, if it were to do so, we would ensure adequate protection of personal data by using the safeguards permitted by law, in particular, the use of the standard contractual clauses approved by the European Commission.

 

6.    What are your rights when you provide us your personal data?

If we process your personal data, you should know that you have the following rights:

              Right to request access to personal data: you can ask if we are processing your data, and if so, you can access them.

              Right to request rectification if the data is inaccurate, or complete the data we have incomplete.

              Right to request the erasure of your data.

              Right to request the restriction of its processing: in that case, we will only keep your information for the exercise or defence of claims.

              Right to object to the processing: we will stop processing the personal data, with the exception that they should continue to be processed for legitimate reasons or for the exercise or defence of possible claims.

              Right to data portability: in case you want your data to be processed by another data controller, we will provide the transfer of your data to the new data controller, if technically possible.

              The right not to be subjected to a decision based solely on the automated processing of your personal data.

If you have given us your consent for any specific purpose, you may withdraw your consent at any time without affecting the lawfulness of the processing based on the consent prior to withdrawal.

To exercise your rights, you must contact us by sending an email to proteccióndedatos@brill-international.com or in writing to the postal address listed in section 1 of this policy.

Whenever you consider it appropriate, you can lodge a complaint with the competent authority, in this case, the Spanish Data Protection Agency (https://www.aepd.es).

 

7.    Additional information

Child Use Policy. Our services are intended only for persons of legal age. In this sense, we do not deliberately collect information from minors. In any case, if parents or legal guardians believe that their children or legal guardians have submitted personal data to us, please contact us by sending an email to proteccióndedatos@brill-international.com.

Modifications. We will only use your personal data as set out in this document which is in force at the time we collect your information. In the event that Brill makes a change to the processing of your data, you will be informed in a timely manner.
